This offer is for Entrants to place an order of at least $25 (excluding fees) via the DoorDash App during the Competition Period to go into the draw to win the Prize (Competition). Permit numbers: TP 24/02312 (ACT).
By entering the Competition, all Entrants acknowledge that they have read, understood and agree to be bound by these Terms and Conditions.
Definitions
The following definitions apply to these Terms and Conditions:
- Competition Period means the period commencing on 14 October 2024 at 12:00am AEDT and ending on 24 November 2024 at 11:59pm AEDT;
- DashPass mean the service offered by the Promoter known as “DashPass” whereby subscribers receive exclusive benefits, deals and offers on orders made by the subscriber on the DoorDash App;
- DashPass Subscriber means an individual who is subscribed to DashPass;
- Draw Date means 3 December 2024;
- DoorDash App means the Promoter’s mobile DoorDash app available on iPhone and Android or the Promoter’s website platform;
- Eligibility Criteria means an individual who:
is an Australian resident;
resides in Western Australia, Victoria, Northern Territory, Tasmania, Queensland, Australian Capital Territory or New South Wales;
is over the age of 18 years old;
has an account on the DoorDash App;
is a current DashPass Subscriber;
is not an employee (or immediate family member of an employee), contractor, representative agent, director or officer of the Promoter or any of the Promoter’s parent, subsidiary, or affiliated companies, marketing agencies, and any other parties involved in the administration of the Competition. Immediate family member means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin;
complies with these Terms and Conditions;
Entrant means an individual who meets the Eligibility Criteria and enters the Competition in accordance these Terms and Conditions;
Luxury Escapes means Luxury Escapes Travel Pty Ltd ACN 150 650 927;
Luxury Escapes’ Website means https://luxuryescapes.com/au;
Prize means credits valued up to AUD$10,000 including GST with Luxury Escapes paid for by the Promoter;
Promoter or DoorDash means DoorDash Technologies Australia Pty Ltd ABN 96 634 446 030 of Level 8, 222 Exhibition Street, Melbourne VIC 3000; and
Website means https://doordash.jotform.com/242870925206862.
How to enter the Competition
To enter the Competition and go into the draw to win the Prize, Entrants must, during the Competition Period, place an order of at least $25 including GST (excluding fees) via the DoorDash App (Entry).
When an Entrant submits a valid Entry, they will receive 1 entry into the Competition to win the Prize.
The maximum number of entries into the Competition per Entrant is unlimited.
If the Entrant’s subscription to DashPass is cancelled after they have submitted their Entry, their Entry will be deemed invalid.
The eligibility of an Entry is solely at the discretion of the Promoter and the Promoter reserves the right to reject any Entry.
How the Prize Winner is selected
The Competition is a game of chance. Skill plays no part in determining the winner of the Prize.
The winning entry of the Competition will be selected at 3.00pm AEDT on the Draw Date using computerised random selection at the Promoter’s office located at Level 15, 222 Exhibition Street, Melbourne VIC 3000.
There will be 1 winning entry of the Competition (Prize Winner). The Prize Winner will receive the Prize.
The Promoter reserves the right to draw additional reserve winning entries and record them in case an ineligible Entry is drawn as a winning entry. The Prize Winner need not be present at the draw.
For the avoidance of doubt, if the Prize Winner is not a current DashPass Subscriber at the time they are drawn as the winner of the Prize, then the Prize Winner’s Entry is deemed ineligible and they will forfeit the Prize in full with no substitute provided.
The Promoter's decision is final, and the Promoter will not enter into correspondence regarding the result of the Competition.
Notification and claiming the Prize
The Promoter will notify the Prize Winner by email within 5 business days of the Draw Date. The Prize Winner’s last name, first initial and postcode will be published on the Website for 28 days following the Draw Date.
The Promoter will take all reasonable steps to identify and notify the Prize Winner, however it is the sole responsibility of Entrants to update their details on the DoorDash App or otherwise provide updated contact details for ease of correspondence and prize notification.
If the Prize Winner cannot be identified by the Promoter or does not claim the Prize before 5.00pm AEDT on 17 December 2024 then the Prize Winner will forfeit the Prize and a new winner will be drawn as follows:
the Promoter will conduct an unclaimed prize draw on 3.00pm AEDT on 18 December 2024 using computerised random selection at the Promoter’s office located at Level 15, 222 Exhibition Street, Melbourne VIC 3000;
the winner of the unclaimed prize draw (Unclaimed Winner) will be notified by email within 2 business days of the unclaimed prize draw; and
the Unclaimed Winner’s last name, first initial and postcode will be published on the Website for 28 days following the unclaimed prize draw.
All terms applicable to the Prize Winner will apply to the Unclaimed Winner.
The Promoter reserves the right to request that the Prize Winner provides proof verifying satisfaction of the Eligibility Criteria to claim the Prize, including proof of identity, age, residency and address. If the Prize Winner cannot provide suitable proof to the Promoter, the Prize Winner will forfeit the Prize in full and no substitute will be provided.
Upon the Prize Winner claiming the Prize, the Promoter will contact the Prize Winner by email and/or phone with details on how they must redeem the Prize.
Upon acceptance of the Prize, the Prize Winner agrees:
their name may be published on the Promoter’s website and social media pages, including Instagram, TikTok and Facebook;
to and sign any disclaimers or any additional agreements, deeds, waivers and/or guarantees required by the Promoter (“Additional Agreement”);
that acceptance, redemption and/or use of the Prize may be conditional on entering into and complying with any Additional Agreement; and
that the Promoter or its promotional partners can use their name, likeness, image and/or voice in marketing (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration in connection to this Competition.
Prize Terms
The total value of the Prize pool is up to AUD$10,000 inclusive of GST (Total Prize Value).
The Prize cannot be used in conjunction with any other offer or discount.
The Prize will be held as a credit with Luxury Escapes and the Prize Winner must use the Prize to select one (1) holiday package with Luxury Escapes available on the Luxury Escapes’ Website. Once the holiday package is chosen, the Promoter will book and pay for the selected holiday package on behalf of the Prize Winner up to the Total Prize Value.
It is a condition of accepting and using the Prize that:
the Prize Winner agrees with and complies with Luxury Escapes’ terms and conditions available at https://luxuryescapes.com/au/terms-and-conditions; and
the Prize Winner agrees with and complies with the terms and conditions of the booking applicable to the Prize Winner’s chosen holiday package.
The Prize will be valid for use for 365 days from the date on which the Prize Winner is first notified that they have won the Prize (Redemption Period). If the Prize Winner is unable or unwilling to book a holiday using the Prize within the Redemption Period, for any reason, including (but not limited to) due to illness or other restrictions, the Prize Winner forfeits the Prize with no entitlement to compensation, reimbursement or alternative prize.
The departure date for the holiday booked using the Prize may be a date after the Redemption Period, provided that the holiday is booked during the Redemption Period.
The Prize may be used to book a holiday for as many individuals as the Prize Winner wishes, provided the Prize Winner is accompanying the individuals and the parties travel together at all times. The Promoter will only pay up to the Total Prize Value towards booking the holiday, and the Prize Winner is liable for paying any amount which exceeds the Total Prize Value.
The Prize Winner’s chosen holiday is at their discretion, but it must be a holiday package advertised by Luxury Escapes on the Luxury Escapes’ Website during the Redemption Period and available for booking. The Prize Winner’s chosen holiday package and travel dates are subject to availability at the time of making the booking. If the Prize Winner’s first chosen holiday package or dates are unable to be booked at the time of attempting to make the booking, then the Prize Winner agrees to choose a different holiday package or vary its travel dates or inclusions to allow for a booking to be made.
The Prize Winner will not receive any full or partial refund or credit if the total value of the Prize is not utilized. No compensation will be payable if the Prize Winner is unable to use any element of the Prize for whatever reason.
The Promoter is not responsible for any travel-related issues or expenses incurred by the Prize Winner in relation to redemption or use of the Prize. The Prize Winner is solely responsible for ensuring that they are eligible to travel to any chosen destinations and that they meet all travel and health regulations/requirements of government authorities of the destinations, such as valid travel documentation (including valid passports and visas) and vaccinations.
If the Prize Winner changes the holiday booking after it has been made, then the Prize Winner may incur charges associated with making the changes. In that case, the Prize Winner will be responsible to pay any such charges.
The Prize Winner acknowledges and agrees that whilst the Prize will be provided by the Promoter, any holiday booking made utilising the Prize will be with one of the providers or suppliers who advertises holiday deals on the Luxury Escapes’ Website, and therefore any resulting contract will be between the Prize Winner and the relevant provider or supplier.
The Prize must be taken as offered and cannot be varied. The Prize is not transferable or exchangeable, and cannot be redeemed for cash or any other currency. If the Prize Winner does not take an element of the Prize at the time stipulated by the Promoter, then that element of the Prize will be forfeited by the Prize Winner and cash will not be supplied for that element of the Prize.
If any element of the Prize is altered, changes or becomes unavailable due to any reason beyond the reasonable control of the Promoter, including but not limited changes as a result of cancellation or change of flights, government directives, pandemic or public health orders, the Promoter takes no responsibility and reserves the right, in its sole discretion and to the fullest extent permitted by law, to change, suspend or cancel the Prize (or any element of the Prize) without providing compensation to the Prize Winner.
If the Promoter becomes aware after the Prize Winner has won the Prize that the Prize Winner has not complied with these Terms and Conditions, the Prize Winner will have no entitlement to the Prize, even if the Promoter has announced them as the winner. That Prize Winner will be required to return, refund or otherwise make restitution of the Prize.
To redeem the Prize, the Prize Winner must agree to and sign any disclaimers or agreements that may be required by the Promoter at its sole and absolute discretion.
General Terms
The Promoter reserves the right to, at any time, verify the validity of Entries, (including their identity, the Eligibility Criteria of an Entrant, and validity of the Entry) and to disqualify any entrants whose entry is not submitted in accordance with these Terms and Conditions, or who otherwise tamper with the entry process. Errors and omissions will be accepted at the Promoter's absolute and unfettered discretion.
The Prize Winner can be disqualified after they are notified by the Promoter.
Entrants acknowledge that any material gathered and produced as a result of their entries will be owned by the Promoter.
The Promoter's decision is final in all aspects of the Competition and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Entrants fully indemnify the Promoter for any breach of these Terms and Conditions.
The Promoter may change or cancel the Competition at any time, subject to laws.
The Promoter is not responsible for any loss or damage suffered by any Entrant or the Prize Winner (however caused) in connection with the Competition, or for any personal injury suffered or sustained as a result of taking the Prize, except for any liability that cannot be excluded by law.
Nothing in these Terms and Conditions excludes, restricts or modifies any rights, liability or remedies under the Competition and Consumer Act 2010 (Cth), or any other law, that cannot be excluded, restricted or modified.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any death, personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising out of or in connection with the Competition, including but not limited to:
technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
theft, unauthorised access or third party interference, whether with an Entrant’s entry or otherwise;
any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) for any reason beyond the reasonable control of the Promoter;
any tax liability incurred by an Entrant; or
taking of or use of the Prize.
If the Competition is interfered with or frustrated in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
to disqualify the Entrant; and/or
to modify, suspend, terminate or cancel the Competition.
The Promoter will collect and use personal information to conduct the Competition and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors and service providers and use the personal information for the purposes described in these Terms and Conditions and the Promoter’s Privacy Policy. Entry by an Entrant is conditional upon them providing this information to the Promoter. The Promoter’s Privacy Policy is available at https://about.doordash.com/en-au/privacy. In addition to the purposes stated in the Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, subject to applicable privacy laws and regulations. All Entries become the exclusive property of the Promoter.
This Competition is not in any way sponsored, endorsed or administered by, or associated with, any social media platform, including Facebook, Instagram or TikTok. By participating in this Competition, Entrants agree to release any social media platform from any and all claims or liability that the claimant may have against the social media platform arising out of this Competition.
The laws of the State of Victoria, Australia apply to the Competition and these Terms and Conditions to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia.
